A Kingston couple have been indicted on charges stemming from an Aug. 1 hit and run on Broadway that left the victim in a coma. Meanwhile, Ulster County District Attorney Emmanuel Nneji said the case might never have been solved if not for the Kingston Police Department’s network of surveillance cameras.

On Monday, an Ulster County grand jury handed up an indictment charging Justin A. Grieco, 35, with second-degree assault, second-degree vehicular assault, driving while intoxicated, leaving the scene of an incident without reporting, third-degree aggravated unlicensed operation, reckless driving and tampering with physical evidence. Katie M. Potter, 39, whom police describe as Grieco’s partner, is charged with felony counts of falsifying business records and insurance fraud for allegedly helping Grieco cover up the crime.

Police say that on the night of Aug. 1, Grieco had been drinking when, at 11:30 p.m. he struck a man crossing Broadway at the intersection of Liberty Street. The unidentified victim suffered serious injuries and remains in a coma in a long-term ICU facility. Police say Grieco left the scene before police arrived. After the incident, police said Potter, who owned the truck Grieco was driving that night, falsified paperwork in an effort to conceal the hit-and-run incident. Grieco and Potter were arrested on Oct. 6. Following an arraignment before state Supreme Court Judge David Gandin, Grieco was remanded to the Ulster County Jail on $20,000 bail.

A statement announcing the indictment said that city police, assisted by the Ulster County Sheriff’s Office, conducted an extensive investigation that included reviewing hours of footage from municipal and privately owned surveillance cameras, the issuing of subpoenas and the execution of search warrants. In August, Nneji appeared before the Kingston Common Council’s Public Safety Committee to speak in defense of KPD’s recently upgraded and expanded network of cameras and automated license plate readers, calling them critical tools for detectives that had helped solve many serious crimes. In a statement, Nneji said that the cameras had provided key evidence in the hit and run.

“Here we have another incident of serious crime that has devastated a man and his family,” Nneji said. “And it easily could have gone unsolved and the driver continuing to offend, were it not for the restricted review and use of public and private camera systems available in the area.”
